Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs use of the HOA in a Box website and platform (the "Services"). It is part of, and incorporated into, our Terms and Conditions. Capitalized terms not defined here have the meanings given in the Terms. You are responsible for your own conduct and for the conduct of anyone who uses the Services through your account.

1. Prohibited conduct

You may not, and may not permit any user or third party to:

  • Use the Services for any unlawful, fraudulent, deceptive, or harmful purpose;
  • Violate, or assist in violating, any applicable law or regulation, including employment, privacy, health-information, anti-discrimination, or export-control laws;
  • Submit information about an individual without the rights, consents, and authorizations required to do so, or use the Services to harass, stalk, surveil, or harm any individual;
  • Misrepresent your identity, your authority to act for an organization or individual, or your affiliation with any person or entity;
  • Use the Services to make automated employment, disciplinary, or eligibility decisions in a manner that bypasses required human and Medical Review Officer review; or
  • Infringe, misappropriate, or violate the intellectual property, privacy, publicity, or other rights of any third party.

2. Content and data restrictions

You may not upload, submit, store, or transmit through the Services any:

  • Content that is unlawful, defamatory, obscene, or that you do not have the right to submit;
  • Sensitive data beyond what the Services are designed to process, or data of categories not contemplated by your agreement with us;
  • Malware, ransomware, or any code, file, or program designed to interrupt, damage, disable, or impair the operation of any software, hardware, or system; or
  • Material that is false or misleading in a way that could compromise the integrity of a testing record or compliance workflow.

3. Security and integrity restrictions

You may not:

  • Attempt to gain unauthorized access to the Services, other users' accounts or data, or any system or network connected to the Services;
  • Probe, scan, or test the vulnerability of the Services, or breach or circumvent any authentication, rate-limiting, or security measure, except under a program expressly authorized in writing (see our Vulnerability Disclosure Policy);
  • Interfere with or disrupt the integrity or performance of the Services, including through denial-of-service attacks, excessive automated requests, or scraping;
  • Reverse engineer, decompile, or disassemble the Services, or attempt to derive source code, except to the extent this restriction is prohibited by applicable law; or
  • Access the Services to build or assist in building a competing product, or resell or sublicense the Services, without our prior written consent.

4. Email and communications

You may not use the Services to send unsolicited bulk messages, spam, or communications that violate the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), or other applicable communications laws, or to impersonate any person in a message.

5. Reporting violations

To report a suspected violation of this AUP, abuse of the Services, or harmful content, contact [email protected]. To report a security vulnerability, email the same address and see our Vulnerability Disclosure Policy.

6. Enforcement

We may investigate suspected violations and may remove or disable content, suspend or limit access, or terminate accounts that violate this AUP. Where a violation poses an immediate risk to the Services, other users, or any individual, we may act immediately and without prior notice. We may cooperate with law enforcement and report conduct we reasonably believe to be unlawful. Our exercise or non-exercise of any right under this AUP is not a waiver of any other right.

7. Changes

We may update this AUP from time to time. When we make material changes, we will revise the effective date above. Your continued use of the Services after an update takes effect constitutes acceptance of the revised AUP.
